Why do we process personal data?

The interested party's personal data is processed in order to manage and develop the municipal towing service.

BSM records the phone numbers of the calls received by the towing service's helpline (tel. 93.7065250). BSM may use a random sample of registered telephones to conduct a telephone survey, in order to assess user satisfaction and measure the quality of the service provided.

A data subject's personal data may also be processed for the following additional purposes, provided they have given their consent for:

  • Sending information and communication of marketing promotions regarding the contracted services and requests to participate in opinion polls for which we may compile purchase profiles and analyse habits based on the information obtained.
  • Including your data on a database shared by BSMSA, PATSA and CBSA.
  • Sending you information and communications relating to the BSM Group's services, activities and promotions, to which end we may compile purchase profiles and analyse habits based on the information obtained.

 

How long do we store the data?

The personal data provided by the interested party will be kept and blocked until the applicable limitation periods have elapsed.

Where the data subject has consented to the processing of their personal data, their data will be stored until the data subject requests their deletion. Their personal data will then be blocked until the applicable limitation periods have elapsed.

What entitles us to process data?

The legal basis for the processing of personal data is public interest and the exercising of administrative powers. As for the other processing, the legal basis is the data subject's previous and unequivocal consent.

 

Which recipients may we communicate personal data to?

A data subject's personal data may be passed on to the following recipients:

  • Companies within the BSM Group.
  • Public administrations, where this is legally established, and Courts of Law and Tribunals.
  • Suppliers who provide services to the BSM Group relating to the management of the service and who have the status of data controllers. In any event, third parties with whom some of the interested party's personal data is shared must have previously accredited the adoption of appropriate measures for the correct management and protection of the data.

 

What are the data subjects’ rights concerning the data they provide?

Every data subject is entitled to receive confirmation on whether we are processing personal data that concern them. Data subjects are entitled to access their personal data as well as to request the correction of inaccurate data or, where appropriate, the deletion of data where, among other reasons, such data are no longer required for the purposes they were collected for.

In certain cases, the data subject is entitled to request the restriction of their data’s processing, in which case their data will only be stored for the purposes of commencing or fighting claims.

Under certain circumstances and for reasons relating to their individual situations, data subjects may refuse to allow their personal data to be processed. In this case, the BSM Group entities against whom the interested party is exercising this right will stop processing this information, except for where there are compelling, legitimate reasons for not doing so or for initiating or defending against possible claims.

In any of the above situations, the BSM Group's corresponding entity will communicate any correction or deletion of personal data as well as any restrictions made to their processing, to each of the recipients to whom the personal data have been transferred, except where this is or requires disproportionate effort. Where so requested by the data subject, the BSM Group entity in question will provide information on the above-mentioned recipients.

The data subject also has the right to receive personal data given to BSM that concerns them, in a structured, common-use, machine-readable format, and to communicate this information to another controller when its processing is based on consent or a contract and is effected through digital means.

At any time and for reasons relating to their personal circumstances, the data subject has the right to object to their personal data being processed for public interest or for BSM's or a third party's legitimate interest, including profiling. This means that BSM or another BSM Group entity must stop processing the personal data unless it can prove that there are compelling, legitimate reasons for such processing which prevail over the interests, rights and liberties of the data subject, or that it needs to do so in order to initiate, conduct or defend any claims.

The data subject is also entitled not to be the subject of a decision based solely on automatic data processing, including profiling, which has legal effects or affects them significantly, unless this decision is needed to enter into or perform a contract with BSM or another BSM Group entity and where the entity has been authorised by current European or national legislation or it is based on the data subject's express consent.

How do we obtain the personal data?

Personal data processed at the BSM Group's various entities come from the data subject concerned and Barcelona City Council.

The categories of personal data that are processed are as follows:

  • Personal identity details
  • Postal and email addresses
  • Economic data
  • Commercial information

For the aforementioned purposes, BSM does not process specially protected data.

 

CCTV

BSM.SA shall process the images captured by cameras and CCTV (in recording and real-time viewing modes) in accordance with the following information:

PURPOSE: To maintain the safety and protection of people and goods, as well as to maintain the security and operability of the entity's equipment and facilities.

LEGAL JUSTIFICATION: The legal basis for processing images through camera or video camera systems in the entity’s facilities is:

  • The fulfilment of a mission of public interest consisting of ensuring the safety of people, property and facilities.
  • The legitimate interest consisting of the need for BSM.SA, as controller, to establish supervision measures to verify that employees comply with their work obligations.

RECIPIENTS: Images may be transferred to the State’s Law Enforcement Agencies as well as to the Courts and Tribunals pursuant to a legal obligation applicable to BSM.SA as controller.

STORAGE: Images captured through the video surveillance recording cameras will be stored for a maximum period of one month as from their date of capture. Once that period has elapsed, those images will then be deleted unless they have to be stored for the purposes of providing documentary evidence of the commission of acts to harm the integrity of people, goods or facilities.

Where the camera system used involves real-time viewing, the images will not be kept insofar as no images are recorded or stored.
